Die Gesellschaft ist nach portugiesischem Recht gegründet und registriert. 
 

§ 2 Geltungsbereich
 
Diese Allgemeinen Geschäftsbedingungen gelten für alle Verträge, die über den Online-Shop zwischen der Electric Crumb – Unipessoal Lda (nachfolgend „Anbieter“) und Verbrauchern oder Unternehmern abgeschlossen werden.
 
Mit Abschluss der Bestellung erklärt sich der Kunde mit diesen Bedingungen einverstanden. 
 
 
§ 3 Vertragsabschluss
 
Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot dar, sondern eine unverbindliche Aufforderung zur Bestellung.
 
Der Vertrag kommt zustande, sobald:
 

1. der Kunde eine Bestellung absendet, und

2. der Anbieter die Bestellung per E-Mail bestätigt oder die Ware versendet.

 
 
§ 4 Produkte und rechtliche Hinweise
 

Unsere Produkte entsprechen den jeweils geltenden gesetzlichen Bestimmungen innerhalb der Europäischen Union.
 
Soweit cannabinoidhaltige Produkte angeboten werden, beträgt der THC-Gehalt maximal 0,2 % (gemäß den in Portugal und der EU geltenden Grenzwerten).
 
Die Produkte werden als Aromaprodukte, Sammlerstücke oder Raumdekoration vertrieben.
Sie sind nicht als Lebensmittel, Arzneimittel oder Medizinprodukte zugelassen.
 
Die Verwendung erfolgt auf eigene Verantwortung des Kunden.

§ 2 Scope of Application

 

 

These General Terms and Conditions apply to all contracts concluded via the online shop between Electric Crumb – Unipessoal Lda (hereinafter referred to as the “Provider”) and consumers or businesses.

 

By placing an order, the customer agrees to these terms and conditions.

 

 

 

§ 3 Conclusion of Contract

 

 

The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.

 

A contract is concluded once:

 

• the customer submits an order, and

• the provider confirms the order by email or dispatches the goods.

 

 

 

 

§ 4 Products and Legal Notice

 

 

Our products comply with the applicable legal regulations within the European Union.

 

Where cannabinoid-containing products are offered, the THC content does not exceed 0.2%, in accordance with applicable limits in Portugal and the European Union.

 

Products are sold as aroma products, collectibles, or decorative items.

 

They are not approved as food, medicinal products, or medical devices.

 

Use of the products is at the customer’s own responsibility.

 

Customers are responsible for ensuring that the import and possession of the ordered products is legal in their country of residence.

 

 

 

§ 5 Prices and Payment Terms

 

 

All prices are final prices including applicable VAT.

 

Shipping costs are shown separately.

 

The following payment methods are accepted:

 

• Credit card

 

 

 

 

§ 6 Delivery and Shipping

 

 

We ship within the European Union.

 

Estimated delivery times:

 

• EU: 1–4 business days

 

 

In the case of advance payment, the delivery period begins once the order has been dispatched.

 

For consumers, the risk of loss or damage passes to the customer only upon delivery of the goods.

 

 

 

§ 7 Right of Withdrawal

 

 

Consumers have a statutory right of withdrawal of 14 days in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU).

 

The withdrawal period is 14 days from the day the customer or a third party designated by the customer receives the goods.

 

For reasons of health protection and hygiene, products cannot be returned if their seal or original packaging has been opened or damaged after delivery.

 

Unopened and originally sealed products may be returned in accordance with applicable legal regulations.

§ 8 Warranty and Liability

 

 

The statutory warranty rights under Portuguese law apply.

 

The provider shall be fully liable in cases of:

 

• intent

• gross negligence

• injury to life, body, or health

 

 

Further liability is excluded to the extent permitted by law.

 

 

 

§ 9 Retention of Title

 

 

Goods remain the property of the provider until full payment has been received.

 

 

 

§ 10 Data Protection

 

 

Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and Portuguese data protection laws.

§ 11 Applicable Law and Jurisdiction

 

 

The law of the Republic of Portugal shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

 

For consumers, mandatory consumer protection laws of their country of residence remain applicable.

 

For business customers, the place of jurisdiction is Lisbon, Portugal, where legally permissible.

  
 
§ 5 Preise und Zahlungsbedingungen
 

1. Alle Preise verstehen sich als Endpreise inklusive der gesetzlich geltenden Mehrwertsteuer.

2. Versandkosten werden gesondert ausgewiesen.

3. Es stehen folgende Zahlungsmethoden zur Verfügung:

§ 6 Lieferung und Versand
 
 

1. Wir liefern innerhalb der Europäischen Union.

2. Lieferzeiten:

   ​

   • EU: 1–4 Werktage
      

3. Bei Vorauskasse beginnt die Lieferfrist ab dem Moment des Versands.

Das Versandrisiko geht bei Verbrauchern erst mit Übergabe an den Kunden über.
  
 
§ 7 Widerrufsrecht

Verbrauchern steht grundsätzlich ein gesetzliches Widerrufsrecht von 14 Tagen gemäß der EU-Verbraucherrechterichtlinie (Richtlinie 2011/83/EU) zu.

Die Widerrufsfrist beträgt 14 Tage ab dem Tag, an dem der Kunde oder ein von ihm benannter Dritter die Ware erhalten hat.

Aus Gründen des Gesundheitsschutzes und der Hygiene sind unsere Produkte von der Rückgabe ausgeschlossen, wenn deren Versiegelung oder Originalverpackung nach der Lieferung geöffnet oder beschädigt wurde.

Ungeöffnete und originalversiegelte Ware kann im Rahmen der gesetzlichen Bestimmungen widerrufen werden.

Sollte es ein Problem mit Ihrer Bestellung geben (z. B. Transportschäden, Falschlieferung oder Qualitätsmängel), wenden Sie sich bitte umgehend an unser Support-Team unter support@ilove-420.com.

§ 8 Gewährleistung und Haftung
 
Es gelten die gesetzlichen Gewährleistungsrechte nach portugiesischem Recht.
 
Der Anbieter haftet uneingeschränkt bei:

• Vorsatz

• grober Fahrlässigkeit

• Verletzung von Leben, Körper oder Gesundheit

 
Eine weitergehende Haftung ist ausgeschlossen, soweit gesetzlich zulässig.
 
 
§ 9 Eigentumsvorbehalt
 
Die Ware bleibt bis zur vollständigen Bezahlung Eigentum des Anbieters.

 
§ 10 Datenschutz 
 
Die Verarbeitung personenbezogener Daten erfolgt gemäß der Datenschutz-Grundverordnung (DSGVO) sowie den portugiesischen Datenschutzgesetzen.

§ 11 Anwendbares Recht und Gerichtsstand
  
Es gilt das Recht der Republik Portugal unter Ausschluss des UN-Kaufrechts.
 
Für Verbraucher gilt zwingendes Verbraucherschutzrecht des jeweiligen Wohnsitzstaates.
 
Gerichtsstand für Unternehmer ist Lissabon, Portugal, soweit gesetzlich zulässig.
